Welcome to DamosTranslation.com (the “Site”), owned by CKSolutions s.r.l.s. (hereinafter “DamosTranslation” or the “Provider”).

Access to and use of the Site and the services offered are subject to full acceptance of these Terms and Conditions (“Terms”). By using the Site, the user declares that they have read, understood, and fully accepted the Terms.

1. Scope of the Service

DamosTranslation.com provides an online service for the translation, interpretation, and descriptive processing of DAMOS files used in the automotive sector.

The service consists exclusively of the technical translation of textual and descriptive contents contained in the DAMOS files provided by the user and the delivery of the translated file.

The service does not include any remapping, calibration, modification, optimization, or alteration of numerical, functional, or operational values of electronic control units (ECUs).

2. Requirements for Use

  • The user must be at least 18 years old and have full legal capacity.

  • The user declares that they lawfully own the DAMOS file or have the right to use it.

  • The service is primarily intended for professional users in the automotive sector (workshops, tuners, technicians, engineers).

3. Service Delivery Method and Use of Artificial Intelligence

The user is informed and accepts that DAMOS file translation services are performed using automated tools based on Artificial Intelligence (AI), possibly assisted by non-systematic human review.

Due to the automated nature of the process and the high technical complexity of DAMOS files, translations are not guaranteed to be 100% accurate, complete, consistent, or error-free.

The service is provided solely for descriptive, indicative, and support purposes and does not constitute technical, engineering, or professional advice.

4. Assumption of Risk and “As Is” Clause

The service is provided “as is”, and the use of translated DAMOS files is entirely at the user’s own risk.

The user acknowledges and accepts that:

  • any errors, omissions, or ambiguities are inherent in the use of Artificial Intelligence systems;

  • it is the user’s sole responsibility to verify, interpret, and validate translated parameters before any use;

  • DamosTranslation assumes no responsibility for technical decisions made based on the translations provided.

The user agrees to indemnify and hold harmless DamosTranslation from any damage, loss, or claim arising from the use of the service.

5. Critical Use Disclaimer

The service is not designed, intended, or authorized for use in critical contexts, including but not limited to:

  • vehicle active or passive safety systems;

  • applications that may directly affect human safety;

  • medical, aeronautical, railway, or critical industrial systems;

  • any use where an error could cause harm to persons or property.

DamosTranslation disclaims any liability for use of the service in such contexts, even if foreseeable.

6. Limitation of Liability

DamosTranslation:

  • does not guarantee specific results;

  • is not responsible for damage to vehicles, ECUs, or components;

  • is not liable for penalties, regulatory violations, or loss of warranty;

  • assumes no liability for the user’s exclusive reliance on the translations provided.

7. Purchase Methods, Prices, and VAT Treatment

  • DamosTranslation services may be purchased exclusively online through the Site.

  • Prices are expressed in Euro and do not include Value Added Tax (VAT), unless otherwise stated.

  • Applicable VAT will be automatically calculated during checkout based on applicable regulations and the information provided by the user.

  • Users holding a VAT number registered in the VIES system may be subject to the reverse charge mechanism in accordance with EU regulations.

  • For users residing outside the European Union, tax treatment will be determined in accordance with the rules applicable to international digital services.

  • Payment must be made in advance using the payment methods available on the Site.

8. Service Delivery

  • The translated file is generally delivered within approximately 2 (two) hours.

  • The service operates from Monday to Saturday, 08:00 – 22:00 (CET).

9. Right of Withdrawal

Pursuant to Article 59 of the Italian Consumer Code (Legislative Decree No. 206/2005), the right of withdrawal is excluded as the service consists of customized digital content.

10. Intellectual Property

All content on the Site is the property of DamosTranslation or the respective rights holders.

The translated DAMOS file is granted to the user for personal or internal professional use only. Unauthorized distribution or disclosure is prohibited.

11. Privacy, GDPR, and Use of Artificial Intelligence

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR).

Uploaded files are processed solely for service delivery purposes and are not used to train Artificial Intelligence models.

The service qualifies as a minimal-risk system under the EU AI Act, as it provides non-decision-making technical support.

12. International and Non-EU Users

Non-EU users access and use the service at their own risk and are responsible for verifying compliance with applicable local laws.

DamosTranslation does not guarantee compliance with regulations other than those of Italy and the European Union.

13. Governing Law and Jurisdiction

These Terms are governed by Italian law.

Any dispute shall be subject to the jurisdiction of the consumer’s court or, in the case of professional users, the court of the registered office of DamosTranslation.

14. Amendments to the Terms

DamosTranslation reserves the right to amend these Terms at any time. Amendments shall be effective upon publication on the Site.
